1.1 Applicability : These Terms apply to any purchase of TeslaStar products by the Customer from the Company.

1.2 Definitions:
“Customer”: The individual or entity purchasing the Equipment.
“Company”: TeslaStar Inc., the provider of the Equipment.
“Equipment”: The TeslaStar water treatment system.

1.3 Disclaimer of Warranties: THE COMPANY HAS A 2 YEAR WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

1.4 Limitation of Liability: THE COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE EQUIPMENT, EXCEPT AS MAY BE REQUIRED BY LAW. THIS INCLUDES, BUT IS NOT LIMITED TO, CLAIMS RELATED TO WATER QUALITY, HEALTH ISSUES (E.G., BACTERIAL INFECTIONS), OR PROPERTY DAMAGE. THE CUSTOMER ACKNOWLEDGES THAT THE EQUIPMENT IS NOT A SUBSTITUTE FOR STANDARD WATER TREATMENT PRACTICES AND MUST ENSURE THAT THEIR WATER MEETS ALL APPLICABLE SAFETY AND HEALTH STANDARDS.

1.5 Satisfaction Guarantee: If the Customer is not satisfied with the Equipment within 30 days of delivery, they may return it for a full refund, minus any installation or removal fees, provided the Equipment is returned in good condition, subject to normal wear and tear. Notices must be in writing and received by the Company within 30 days of delivery.
1.6 Payment Terms: All payments are due upon receipt.

1.7 Repossession Upon default: The Company may repossess the Equipment without liability.

1.8 Equipment as Personal Property: The Equipment is personal property and not affixed to real estate.

1.9 Acknowledgment: The Customer acknowledges that they have not relied on any statements or representations not contained in these Terms.

1.10 Governing Law: These Terms shall be governed by the laws of Alabama.

1.11 Entire Agreement: These Terms constitute the entire agreement between the parties and supersede all prior agreements and understandings.

1.12 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

1.13 Waiver Failure: Waiver Failure by the Company to enforce any provision shall not be deemed a waiver of such provision or any other provision.

1.14 Notices: All notices shall be in writing and delivered via mail, email, or fax to the addresses provided by the parties.

1.15 Compliance with Laws: The Customer is responsible for ensuring that the use of the Equipment complies with all applicable local, state, and federal regulations regarding water treatment and quality.

1.16 Non-Medical Use: The Equipment is not intended for use in medical applications or to diagnose, treat, cure, or prevent any disease. Customers should consult with appropriate professionals for health-related concerns.

1.17 Intellectual Property: The Equipment and any related technology are proprietary to the Company and are protected by intellectual property laws. The Customer shall not reverse engineer, modify, or attempt to derive the composition or operation of the Equipment.

TeslaStar’s Unique Process: TeslaStar uses a proprietary physical process to enhance water clarity, reduce algae and bacteria growth, and create hydrogen-rich, structured water without chemicals. However, it is not a sterilization method and does not guarantee the complete elimination of all microorganisms. Customers are responsible for ensuring their water meets all applicable health and safety standards.

Use with Other Treatments: TeslaStar can be used as a standalone solution or in combination with other water treatment methods, depending on the Customer’s needs and local regulations.

Installation: Installation of the Equipment is the responsibility of the Customer, unless installation services are purchased separately from the Company.
